Please read these Terms carefully
These Terms & Conditions form a binding agreement between you and NeuralNest Solutions (NNS), an India-based company and the operator of Event Trekker. By creating an account or using Event Trekker, you accept these Terms.
If you do not agree to these Terms & Conditions, do not use Event Trekker.
1. The agreement
These Terms & Conditions ("Terms") form a binding agreement between you and NeuralNest Solutions (NNS) ("NNS", "we", "us"), an India-based company and the operator of Event Trekker (the "Service"). By creating an account or using the Service, you accept these Terms. If you do not accept them, do not use the Service.
These Terms incorporate by reference our Privacy Policy, Cookie Policy, and Accessibility Statement.
2. Who can use Event Trekker
You must be at least 16 years old, or the age of digital consent in your jurisdiction if that is higher, to create an Event Trekker account. If you are under that age, you may use the Service only through an account belonging to a parent or legal guardian.
If you are using Event Trekker on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
3. Your account
You are responsible for keeping your sign-in credentials safe. We recommend Google or Apple sign-in plus a phone-level passcode / biometric. You are responsible for everything that happens under your account; tell us immediately at support@neuralnestsolutions.com if you suspect unauthorised access.
4. Organizer access boundary
Event Trekker is organised around the Organizer (a travel group, e.g., "Smith + Patel families"). Within an Organizer, every Member can see and edit every Event (trip) that belongs to that Organizer. Across Organizers, access is denied by default — a Member of Organizer X cannot see any Event in Organizer Y.
When you invite someone to your Organizer, you are giving them access to every existing and future Event in that Organizer. We will tell them this in the invite. If you want a different set of people to see a different trip, create a new Organizer for that trip.
5. License to use the app
We grant you a personal, non-exclusive, non-transferable, revocable license to use Event Trekker for non-commercial trip-planning purposes, subject to these Terms. You may not:
- Reverse-engineer, decompile, or attempt to derive source code from the Service.
- Resell, sublicense, or commercialise access (e.g., running a paid travel-agency tool on top of Event Trekker without a separate written agreement with us).
- Scrape or programmatically extract data belonging to other users.
- Circumvent rate limits, security controls, or access boundaries.
6. Your content and what we may do with it
"Your Content" means everything you upload or generate in the Service: trips, activities, ticket attachments, expenses, notes, photos, and the like. You own Your Content. We do not claim ownership.
You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and back up Your Content solely to operate and improve the Service for you and for the Members of your Organizer(s). This license terminates when you delete Your Content or your account (subject to backups; see our Privacy Policy §7).
You represent that you have the right to upload everything you upload — including QR codes and PDFs from third-party booking sites — and that doing so does not violate any agreement you have with those third parties.
7. Acceptable use
You will not:
- Use the Service for any unlawful purpose, including booking activities that are illegal where they occur.
- Upload malware, viruses, or content designed to harm other users or our infrastructure.
- Harass, threaten, dox, or impersonate another person.
- Upload content that infringes copyright, trademark, or other intellectual-property rights.
- Use the AI features (§8) to generate harmful, hateful, or illegal content.
- Attempt to gain unauthorised access to other users' Organizers or Events.
We may, at our discretion and with notice unless the violation is urgent, suspend or terminate accounts that breach this section.
8. AI features (Gemini)
Event Trekker offers AI-drafted timelines and AI-scaffolded activities via Google's Gemini API. AI output is a draft, not a recommendation. You must verify venue hours, ticket availability, weather, visa requirements, transit schedules, and anything safety-critical before relying on an AI-suggested activity.
AI features are consent-gated; see Privacy Policy §5. You may revoke AI consent any time. We are not responsible for losses arising from AI-drafted activities that did not match real-world conditions.
9. Pricing and payments
Event Trekker is free at launch — no paid tiers, no in-app purchases, no advertising. If we introduce paid features in future, we will announce them at least 30 days before they take effect and you will have the choice to keep using the free tier or upgrade. Any payment terms will be set out in a clearly-labelled addendum.
10. Service availability
We aim for high availability but make no specific uptime promise. The Service may be interrupted by maintenance, third-party outages (e.g., Google Cloud, app stores), or force majeure. Your trip data is cached on your phone for 21 days, so the timeline and your attachments remain usable even during a backend outage.
11. Third-party services
Event Trekker integrates with third-party services (App Store, Play Store, Google sign-in, Apple sign-in, Gemini, AWS SES). Your use of those services is subject to their own terms and privacy policies. We are not responsible for their conduct.
12. Disclaimers
Event Trekker is provided "as is" and "as available", without warranties of any kind, express or implied, including (without limitation) merchantability, fitness for a particular purpose, non-infringement, and accuracy of AI-generated content. We do not guarantee that AI-drafted activities are correct, available, or appropriate for your trip; you are the final decision-maker for every activity you accept.
13. Limitation of liability
To the maximum extent permitted by applicable law:
- We are NOT liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.
- Our total cumulative liability to you, for any and all claims arising out of or relating to the Service in any 12-month period, is capped at the greater of US$50 or the amount you paid us in that 12-month period.
- Nothing in these Terms limits liability that cannot be limited or excluded under applicable law (for example, liability for gross negligence, fraud, or death / personal injury caused by our negligence).
14. Indemnity
You will indemnify and hold NNS and its officers, employees, and contractors harmless from any third-party claim arising out of (a) your breach of these Terms, (b) Your Content, or (c) your misuse of the Service. We will tell you promptly of any such claim and let you choose counsel (subject to our reasonable approval) and control the defence.
15. Termination
You may terminate by deleting your account in-app at any time (Settings → Account → Delete). We may terminate or suspend your account if you breach these Terms, with notice unless the breach is urgent (security, fraud, immediate harm to others).
Sections 6 (Your Content licence — for backup retention), 12 (Disclaimers), 13 (Liability), 14 (Indemnity), and 16 (Governing law) survive termination.
16. Governing law & disputes
NeuralNest Solutions (NNS) is based in India. These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Subject to §16.2 below, the courts at Bangalore, Karnataka, India have jurisdiction over any dispute arising out of or relating to these Terms. Mandatory consumer-protection laws of your country of residence still apply on top.
16.1 Informal resolution first
If you have a dispute with us, please write to support@neuralnestsolutions.com and give us 30 days to resolve it informally. Most disputes are resolved this way.
16.2 Arbitration
If informal resolution fails, any dispute may, to the extent permitted by applicable law, be referred to arbitration under the Arbitration and Conciliation Act, 1996 of India. The seat and venue of arbitration will be Bangalore, Karnataka, India; the language will be English; and the arbitration will be conducted by a sole arbitrator. Each party bears its own costs until the arbitrator decides otherwise. Nothing in this clause prevents either party from seeking urgent interim relief from a court of competent jurisdiction.
16.3 EU / UK users
If you reside in the European Union, the United Kingdom, or another jurisdiction whose mandatory consumer-protection law applies, you may bring claims in the courts of your country of residence, and any mandatory local consumer-protection rights are not affected by §16.1–§16.2 to the extent local law so requires.
16.4 India users
If you reside in India, the DPDP Act, 2023 governs your data-protection rights, and our Privacy Policy §13 sets out the Grievance Officer mechanism. Other disputes follow the governing-law and jurisdiction provisions above.
17. Changes to these terms
We may update these Terms. Material changes take effect 30 days after we notify you in-app and by email; minor changes are effective on posting and summarised in the changelog below. If you do not accept a material change, you may stop using the Service and delete your account.
